TerraSky (Thailand) Co., Ltd. (hereinafter referred to as “we”, “our”, or “us”) has full awareness of the vital importance of personal data protection in an efficient manner satisfying fundamental principles of data protection of our customers, shareholders, suppliers, business partners, applicants for potential recruitment activities and other third parties contacting us in accordance with the Personal Data Protection Act B.E. 2562 (2019), and any statutory amendments or re-enactments made of the Personal Data Protection Act B.E. 2562 (2019) from time to time (collectively referred to as the “PDPA”), as well as laws and practices that have generally been in effect at present.

 

Please read this policy carefully as it describes how we collect, use, disclose, and/or transfer your personal information.

 

1. Types of personal data we collect

 

"Personal Data" means any information relating to an identified or identifiable of such person,  

whether directly or indirectly, but does not include the specific information of the deceased person.

 

We may collect, use, disclose or transfer your Personal Data only within the scope of the purposes indicated when we obtain such data. The Personal Data that we hold may include the following but not limited to:

 

  • Identification information includes your name, surname, photo, date of birth, gender, nationality, email address, telephone number, job position or other certificate/ document that may be required by the Company from time to time, or similar identifiers or contact information.

  • Technical Data includes internet protocol (IP) address, your login data, Cookies ID, user IDs, browser type and version, time zone setting, location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access our websites, applications, or connected products

  • Usage and service behavior information includes usage and service behavior information of the Company and/or business partners of the Company including the usage of network service or products related to the services

  • Usage Data includes information about how you use our websites and our products and services and your feedback on your experience with our websites, products, or services.

  • Marketing and Communications Data includes data about individuals participate in event/seminar registration, your preferences in receiving marketing campaigns and your communication preferences.

 

 

By providing your Personal Data, you consent to us to process your Personal Data in accordance with this Privacy Policy, and you confirm that all your Personal Data is accurate and complete, and that none of it is misleading or out of date. You will promptly update us in the event of any change to your Personal Data.

 Information that we collect from other sources:

 

  • We may receive your Personal Data from third parties, which are allowed to disclose

your information by your consent under applicable law. These third parties include but not

limit to our business partners, sub-contractors, venders that help the Company to process and provide services by email, phone, document, or via other electronic means in which

the disclosure person has the right to provide personal information lawfully or to be

informed through various service processes in the Company that collects the information itself as described above.

 

2.  Sources of Personal Data

 

We shall acquire Personal Data directly from you or any other sources, including, but not limited to the following by legitimate and fair means within the scope necessary for our business activities:

  • When you sign up for any of our services or when you receive one of our services.

  • When you contact our representatives at office buildings, sales, and service centers, or via electronic means;

  • When you fill in an inquiry form asking about our products and services, or by email correspondence or any other means e.g., Short Message Service, Post - etc., this includes the processes of filling the request to exercise your rights. If you participate in our surveys or sending us your inquiries, we may request your contact details e.g., telephone number, address, email address) to confirm your participation eligibility, to contact you, and otherwise administer the event;

  • When you voluntarily respond to our recruitment process including when you upload and submit your resume though our website, electronics means or filling in an online application for a particular position advertised on our website or in person (by provide Personal Data to our team in written form or orally);

  • When you visit the Company's website through your browser's cookies;

 

3. Purpose of Personal Data processing

 

We may use your personal information for the following purposes:

(a)  To provide you with information and fulfill our operation on the services efficiently;

(b)  To conduct, research, analysis for better services development;

(c)  To resolve complaints, handle and respond to your request and enquiries;

(d) To contact and communicate with you to proceed the recruitment process;

(e)  To record sales activities and to perform financial controls, procurement and payment;

(f) Any other purposes that are incidental or ancillary or in furtherance to the above

      purposes.

 

4. How we process your Personal Data

 

After receiving your Personal Data, we normally use, collect and/or process your Personal Data which is required or allowed by any law that applies and for the purposes specified in previous session only. We will not use the information for any other purpose unless your consent has been obtained or where it is permitted or required by law. That is based on a lawful basis for processing the data.

Besides the case that the Company processes Personal Data for performing of the contract and complying with the laws, in some cases, we may require your consent for the collection, use or disclosure of your Personal Data to provide you the best benefits and/or for the Company to be able to provide services that meet to your needs appropriately. If you refuse to provide your Personal Data, we may not be able to provide services to you.

 

5. Provision and disclosure to third parties

 

The Company may disclose Personal Data and any information about your use of the service or any other information that the Company collected as described in section 1 above to the following parties within Thailand and/or oversea or business partners, which such destination countries may or may not have Personal Data protection standard as comprehensive as those that exist in Thailand, and the same level of protection as that set forth in the PDPA may not necessarily be guaranteed. In such case, we shall implement the necessary safety management measures pursuant to the requirements of the PDPA.

(2)  To third-party agents/suppliers or contractors bound by obligations of confidentiality, in connection with the processing of your Personal Data for the purposes described in this Privacy Policy (this may include, without limitation to, financial organizations, business, advisors, office building lessor, audits company, law firms, marketing agencies, accounting providers, and IT service providers)

(3)  To the extent required by laws, regulations, or court orders (for example, if we are under a duty to disclose your Personal Data to comply with a legal obligation).

Other than as described in this Policy, we will not provide your information to any third parties without your consent, except for cases where you use services linked to a third party, or other cases where the minimum information necessary for partners to identify users is provided.

 

6. Data storage and retention period

 

Your Personal Data will be stored securely on our data server or in a third party’s data server. We will strictly control access to this information and will review such access control from time to time.

Retention period:  We will not keep your Personal Data for longer than is required for the purpose for which it has been collected or processed, in accordance with the applicable laws and regulations, or, in any case, to allow us to protect its legitimate rights and interests or those of third parties.

Once the processing purposes are completed or you otherwise end your relationship with us, we will erase or destroy or aggregate and/or anonymize your Personal Data from our systems and records to an extent that it no longer identifies you within a reasonable time. We may also retain your personal information if your personal information is necessary to comply with any applicable laws.

 

7.  Rights of Data Subject

 

You, as a data subject, have the right to access Personal Data, request the correction or erasure, request the limitation of processing, object to the processing, withdraw consent, and request the data portability of your Personal Data retained by us.

If you have given your consent for a specific processing purpose to us, you can withdraw your consent for the specific proposal any time unless there are restrictions on legal rights or in connection with the contract that benefits you. However, the withdrawal of such consent shall not affect the processing of Personal Data for which you have already legally given consent to us. You also have the right to lodge a complaint with the competent data protection supervisory authority.

To exercise your rights, please contact us as stated at the end of this policy. Upon receipt of a request for display, correction, erasure, withdrawal of use of Personal Data, we will promptly respond to such requests based on the results of the investigation. You are not obligated to pay any charges.

We have the right to refuse to comply with data access request in case of irrelevant information, high expenses and risks, effect on other's data, violation of order of court, and disclose confidential commercial information
